This Barron Prize Privacy Policy (“Privacy Policy”) covers our treatment of personal information and other information that we collect when you: (a) access or use the Site; (b) access and/or download any of the text, inspiring stories, testimonials, blog posts, Contest (as defined below) winner lists, media mentions, audio, video, photographs, graphics, artwork and/or other content featured on the Site (collectively, “Content”); (c) access any third-party links to information and/or resources located at other web-based venues (“Third-Party Links”); (d) access, fill out and submit the online application to participate in the Gloria Barron Prize for Young Heroes Contest (“Contest”) for a chance to win the Gloria Barron Prize for Young Heroes (“Gloria Barron Prize”); (e) access links to Barron Prize’s social media pages/accounts on third party social media websites (“Social Media Websites”), such as Facebook®, Instagram®, X® and YouTube® (collectively, “Social Media Pages”); and/or (f) utilize the various contact forms and/or contact information made available on the Site as a means to contact directly, or request to be contacted by, Barron Prize (collectively, the “Contact Services,” and together with the Site, Content, Third-Party Links, Contest, Gloria Barron Prize and Social Media Pages, the “Barron Prize Offerings”).
Capitalized terms not defined herein shall have the meaning set forth in the Barron Prize Website Terms and Conditions (“Terms and Conditions”). Residents of the States of California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia, businesses organized under the laws of the State of California, as well as California-based employees of, and California residents who submit job applicants to, Barron Prize (collectively, “Covered Users”), are afforded additional rights pursuant to applicable state law. Shine the Light. If you are a resident of the State of California and would like to learn how your “personal information” (as defined in the Shine the Light Law, Cal. Civ. Browser “Do Not Track” Signals. Most browsers contain a “do-not-track” setting. In general, when a “do-not-track” setting is active, the user’s browser notifies other websites that the user does not want her/his personal information and online behavior to be tracked and used, for example, for interest-based advertising. Personal Information Collected
For the purposes of this Privacy Policy, “personal information” shall mean individually identifiable information from or about an individual. We collect personal information when you register for certain of the Barron Prize Offerings. Users under sixteen (16) years of age must have a parent or legal guardian provide verifiable consent before such users submit any registration Form or other personal information by and through the Barron Prize Offerings. The information that we may request when you attempt to access Barron Prize Offerings, may include, but is not limited to: (a) your full name; (b) your mailing address; (c) your e-mail address; (d) your telephone number; (e) the name of your Project (as defined below), where applying for entry in the Contest; (f) the social media accounts associated with your Project, where applying for entry in the Contest; (g) the name, mailing address and telephone number of the school that you are currently attending, and your current year in that school, where applying for entry in the Contest; (h) your Project-related written summary, essay, reference letters, photographs and supplemental materials, where applying for entry in the Contest; and/or (i) any other information requested by us on the Form. We may also collect your personal information when you otherwise agree to the terms of this Privacy Policy, but do not complete the applicable registration process in full.
Use and Sharing of Personal Information
The personal information that you submit to Barron Prize remains your property. Barron Prize will never sell, rent, exchange or barter your personal information to or with any third party for financial gain or marketing purposes.
Where you submit an application in connection with the Contest, we use your application, and associated information, solely to evaluate your Contest entry and eligibility for a Gloria Barron Prize, and to contact you in connection with same. Where you register to access any of the Barron Prize Offerings, we use the personal information that you make available to personalize your experience with the Site, facilitate the delivery of the applicable Barron Prize Offerings to you and for verification purposes. You also agree that we may contact you at any time with updates and/or any other information that we may deem appropriate for you to receive in connection with your continued use of the Barron Prize Offerings, including your entry in the Contest.
In addition, if you identify yourself to us by sending us an email or some other communication with questions or comments, we may use such information (including personal information) to respond to your questions or comments, and we may file your questions or comments for future reference.
Where users who are above the age of majority in their respective jurisdictions of residence (“Adult Users”) make personal information available to Barron Prize, those Adult Users grant Barron Prize the right, subject to applicable state and federal law, to use that personal information to send those Adult Users email communications that contain certain promotional material from Barron Prize and/or T. A. Barron. If any users wish to stop receiving future communications from us, please see the Opt-Out/Unsubscribe section below.
We may permit our third-party agents, service providers, vendors and subcontractors, such as WizeHive, Inc. (“WizeHive”), to access your personal information, but they are only permitted to do so in connection with performing services for us and/or to operate the Barron Prize Offerings. WizeHive assists us in connection with the collection and processing of applications associated with the Contest. These third parties, including WizeHive, are not authorized to use that personal information for their own benefit.
Where an Adult User and/or the Parent or Guardian of Authorized Minor who has undergone our age verification process submits her/his/its personal information by and through the Barron Prize Offerings, that Adult User and/or Parent or Guardian, as applicable, agrees that such act constitutes an inquiry and/or application for purposes of the Amended Telemarketing Sales Rule (16 CFR §310 et seq.), as amended from time to time (the “Rule”) and applicable state do-not-call regulations. As such, notwithstanding that such Adult User’s telephone number may be listed on the Federal Trade Commission’s Do-Not-Call List, and/or on applicable state do-not-call lists, we retain the right to contact that Adult User via telemarketing in accordance with the Rule and applicable state do-not-call regulations.
Where an Adult User and/or the Parent or Guardian of Authorized Minor who has undergone our age verification process provides “prior express consent” within the meaning of the Telephone Consumer Protection Act (47 USC § 227), and its implementing regulations adopted by the Federal Communications Commission (47 CFR § 64.1200), as amended from time-to-time (“TCPA”), that Adult User and/or Parent or Guardian, as applicable, consents to receive telephone calls (including text alerts via SMS text messages) from Barron Prize delivered via automated technology, to the telephone number(s) that such Adult User provided. Please note that no user is required to provide this consent in order to obtain access to the Barron Prize Offerings, and an Adult User’s and/or Parent or Guardian’s consent, as applicable, consent simply allows Barron Prize to contact that Adult User via these means. Please be advised that by agreeing to this Privacy Policy, each Adult User and/or Parent or Guardian, as applicable, is obligated to immediately inform us if and when the telephone number that the Adult User and/or Parent or Guardian, as applicable, had previously provided to us changes. Without limiting the foregoing, if an Adult User and/or Parent or Guardian, as applicable: (a) has her/his/its telephone number reassigned to another person or entity; (b) gives up her/his/its telephone number so that it is no longer used by such Adult User and/or Parent or Guardian, as applicable; (c) ports her/his/its telephone number to a landline or vice versa; or (d) otherwise stops using that telephone number for any reason (collectively “Phone Number Change”), that Adult User and/or Parent or Guardian, as applicable, agrees that she/he/it shall promptly notify Barron Prize of the Phone Number Change via e-mail at: admin@barronprize.org, or by using one of the methods set forth in the “Contact Us” section below.
We reserve the right to release current or past personal information: (i) in the event that we believe that the Barron Prize Offerings are being, or have been, used in violation of the Terms and Conditions, the rules applicable to any Promotion or to commit unlawful acts; (ii) if the information is subpoenaed; provided, however, that, where permitted by applicable law, we shall provide you with e-mail notice, and opportunity to challenge the subpoena, prior to disclosure of any personal information pursuant to a subpoena; (iii) if we are sold, merged or acquired (collectively, “M&A Transactions”) (including where we share your personal information in connection with the due diligence process associated with a potential M&A Transaction); or (iv) if we are the subject of bankruptcy proceedings; provided, however, that if we are involved in an M&A Transaction or bankruptcy proceeding, you will be notified via email and/or a prominent notice on the Site of any change in ownership or uses of your personal information, as well as any choices that you may have regarding your personal information.
Social Media Websites
If you post feedback, or otherwise provide personal information by and through any applicable Social Media Websites, you should be aware that any personal information that you submit using such forums can be read, collected or used by other users of these forums (depending on your privacy settings on the applicable Social Media Websites), and could be used to send you unsolicited messages or otherwise contact you without your consent or desire. We are not responsible for the personal information that you choose to submit in these forums.
Further, where an Adult User submits material via the Social Media Websites, that Adult User: (a) represents and warrants that Barron Prize’s use of the submission does not and will not breach any agreement, violate any law, violate any Social Media Website’s terms of service or infringe upon any third party’s rights; (b) agree that Barron Prize is free to use in any manner all or part of the feedback and/or other material on an unrestricted basis without the obligation to notify, identify or compensate the subject Adult User or anyone else; and (c) grant Barron Prize all necessary rights, including a waiver of all copyright, trademark, privacy and moral rights, to use all feedback and/or other material, in whole or in part, or as a derivative work, without any duty of Barron Prize to anyone whatsoever.
Non-Personal Information Collection and Use
IP Addresses/Browser Type
Only where we receive the consent of Adult Users, and/or the Parent or Guardian of Authorized Minors, who are subject to our age verification protocols, will we collect certain non-personally identifiable information about Adult Users and/or Authorized Minors, as applicable, when those Adult Users and/or Authorized Minors visit many of the pages of the Site. This non-personally identifiable information includes, without limitation, the type of browser used (e.g., Safari, Chrome, Internet Explorer), IP address, the type of operating system used (e.g., Windows or iOS) and the domain name of the applicable Adult User’s and/or Authorized Minor’s Internet service provider (e.g., Verizon, AT&T). We use the non-personally identifiable information that we collect to improve the design and content of the Site and to enable us to personalize your Internet experience. Security of Your Personal Information
We endeavor to safeguard and protect our end-users’ personal information. When end-users make personal information available to us, their personal information is protected both online and offline (to the extent that we maintain any personal information offline). The privacy of your personal information is very important to us. When our registration process asks end-users to submit sensitive personal information (if any), and when we transmit such sensitive information, that information is encrypted and is protected with advanced TLS (Transport Layer Security).

The servers that we store personal information in are kept in a secure physical environment. Please be further advised that, after you delete your personal information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm your verifiable Covered User request, we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we have shared that personal information.
- The specific pieces of personal information we collected about you (also called a data portability request).
- If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion Request Rights
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable Covered User request, we will delete (and direct our service providers, contractors and third parties to whom we shared your personal information, to delete) your personal information from our (their) records, unless an exception applies; provided, however, that in some cases, strictly for regulatory compliance purposes and to better evidence/honor opt-out/unsubscribe requests (and for no other purposes), we may retain certain items of your personal information on a de-identified and aggregated basis in such a manner that the data no longer identifies you.
We may deny your deletion request if retaining the information is necessary for us or our service providers, contractors and third parties to whom we sold/shared your personal information, to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our obligations in connection with our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity, or prosecute those responsible for such activities.

- Exercise free speech rights, ensure the right of another Covered User to exercise her/his free speech rights or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 ).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, but only if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with Covered User expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Right to Request Correction of Inaccurate Personal or Sensitive Personal Information
You have the right to request correction of inaccurate personal and/or sensitive personal information that we collect. Upon receiving a verifiable consumer request for correction, we will make commercially reasonable efforts to correct information identified as inaccurate. Where we correct inaccurate personal and/or sensitive personal information, we shall instruct all service providers and/or contractors that maintain such personal and/or sensitive personal information in the course of providing services to us to make the necessary corrections in their respective systems.
Exercising Access, Data Portability, Right to Correct and Deletion Rights

The verifiable Covered User request must:
- Provide sufficient information that allows us to reasonably verify that you are: (1) the person about whom we collected personal information; or (2) an authorized representative.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable Covered User request does not require that you create an account with us. We will only use personal information provided in a verifiable Covered User request to verify the requestor’s identity or authority to make the request.
Response Timing and Format
We endeavor to respond to all verifiable Covered User requests within forty-five (45) days of the receipt thereof. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures that we provide will only cover the twelve (12) month period preceding the receipt of your verifiable request. The response that we provide will also explain the reasons that we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable Covered User request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Right to Opt-Out of Profiling
We do not conduct any profiling of users under eighteen (18) years of age. Adult Users have the right to opt-out from any Profiling that may be conducted by Barron Prize. For purposes of these Provisions, “Profiling” means any form of automated processing performed on an Adult User’s personal data to evaluate, analyze or predict personal aspects related to that Adult User or that Adult User’s economic situation, health, personal preferences, interests, reliability, behavior, location or movements. For purposes of these Provisions, “Targeted Advertising” means displaying advertisements to an Adult User where the advertisements are selected based on personal data obtained from that Adult User’s activities over time and across nonaffiliated websites or online applications to predict that Adult User’s preferences or interests. Authorized Agents
Covered Users may permit an Authorized Agent to exercise any rights granted under Applicable State Laws as set forth above. In order to utilize an Authorized Agent, you must provide the Authorized Agent with written permission from you to act on your behalf for these purposes. When you use an Authorized Agent to submit a request to delete, request to correct or a request to know, we may require the Authorized Agent to provide proof that you gave the agent signed permission to submit the subject request. We may also require you to do either of the following: (a) verify your own identity directly with us; or (b) directly confirm with us that you provided the Authorized Agent permission to submit the request.
For California residents, only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable Covered User request related to your personal information.
Non-Discrimination
We will not discriminate against you for exercising any of your rights under Applicable State Laws. Unless permitted by Applicable State Laws, we will not:
- Deny you goods or services;
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
- Provide you a different level or quality of goods or services;
- Retaliate against any employee, job applicant or independent contractor; and/or
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Changes to these Privacy Provisions
We reserve the right to amend these Privacy Provisions in our discretion and at any time. When we make changes to these Privacy Provisions, we will notify you by email or through a notice on the Site’s homepage.
